East Idaho News published a story today about David Ellis, a man accused of shooting and killing his neighbor’s puppy.
David Ellis has been charged with malicious injury to property and concealment of evidence, both felonies. While these charges are not specifically animal-related, could this case set any legal precedent for similar incidents in Idaho as dogs are considered property in our state? We applaud the Lemhi County Sheriff’s Office for going above and beyond on this case.
According to court documents, on Jan. 15, a Lemhi County Sheriff’s deputy responded to a report from a couple who claimed Ellis shot their dog, Annie, and refused to return the body. The couple stated that Ellis had previously threatened to harm the dog and insisted she was not harassing his cattle at the time of the shooting.
Ellis admitted to shooting the dog, claiming it had pushed his cows against a fence. However, police reports indicate there were no cattle on the property when the dog was killed. Ellis allegedly disposed of the body, telling deputies, “They are not getting it back.”
The couple later discovered their dog’s remains and filmed Ellis attempting to destroy evidence at the scene. The deputy documented the site and returned the body to its owners.
On Jan. 20, Ellis met with deputies and admitted to the shooting but refused further questioning. Days later, the couple reported that Ellis was driving past their home, watching them and waving. The wife expressed fear for her family’s safety, believing Ellis to be dangerous.
Ellis was charged on Jan. 29 and summoned to court, but not arrested. A no-contact order was issued, and he is set to appear for a preliminary hearing on March 11.
If convicted, Ellis could face up to 10 years in prison. He is presumed innocent until proven guilty.
